Election Update

Humble ISD has determined that Brittnai Brown, who was recently elected to the School Board, is ineligible to serve due to not meeting legal candidacy requirements.

A Declaration of Ineligibility was issued on May 20, 2025, by the school district, after a review of public records. Specifically, Brown’s voter registration on February 14, 2025 — the deadline for filing candidacy for the May 3, 2025, election — did not have an Humble ISD address in effect. According to Texas Election Code section 141.001, a candidate must be registered to vote within the district from which they are seeking office by the filing deadline.

Brown’s voter registration listed her residency in Houston ISD until she changed her address on her voter registration to Humble ISD. The change became effective on March 16, 2025. Texas Secretary of State guidelines specify that address changes for voter registration become effective 30 days after submission and acceptance.

Humble ISD is required to declare a candidate ineligible if public records, such as voter registration forms, conclusively establish ineligibility. The Texas Supreme Court has emphasized that election candidacy requirements are mandatory and must be enforced.

When receiving candidate filings, the school district checks that the address on the application for a place on the ballot is within Humble ISD and that the candidate is a registered voter. Candidates sign that they are eligible to hold office under the laws of the state. Humble ISD has not experienced a problem with candidate voter registration in prior elections.

Election results for the May 3, 2025, election for Position 4 on the seven-member School Board were: Brittnai Brown, 4,066; Ken Kirchhofer, 3,197; Tracy Shannon, 3,237.

Humble ISD uses a plurality voting system, where the candidate with the most votes wins without a runoff, unless there is a tie. School Board members are elected at large and serve four-year, unpaid terms.

As a result of the ineligibility ruling, a vacancy exists on the School Board. Under Texas law, the Board may either hold a special election or appoint a replacement to fill the position.

Until the vacancy is addressed, incumbent member Ken Kirchhofer continues to serve under Texas law regarding vacancies. The School Board has not yet met to determine the method for filling the vacancy.

The other recently-elected Board members are scheduled to take the Oath of Office on June 10, 2025, during the regular monthly meeting.
